It has been reported many times people pass with no issues. The EGR was deleted from the factory in later year JDM models.
If you delete it and cap it off as needed but leave the valve in place so that you can pass the visual inspection as needed. That is unless you've got a new guy that will go over the top checking the system. I would assume most people would just peak over the back of the engine to make sure it's still in place.
